is subject to the following Customer Agreement ("the Agreement"). The

and deletion to its provisions, but only the notices that Auctiondirectjapan.com
considers important to its members will be posted on the Auctiondirectjapan.com
Site. We recommend you to review the most current version of the Agreement
when using the Auctiondirectjapan.com Site
Auctiondirectjapan.com provides the following services (the "Service"):
Provides detailed data and photos of auction vehicles(salvaged/used
cars, boats, spare parts and other units) in our Auction Agent Service
and Stock List for sale to our customers.
For each vehicle listed on the Stock, Auctiondirectjapan.com provides an estimated shipping/delivery charge upon your request, based on the destination of your choice.
By providing a unique Customer ID and password, Auctiondirectjapan.com facilitates your personal page where you can review and change your personal information such as contact name, address, telephone number, and display detailed data of your ordered vehicles and payment/shipping status.
Offers detailed descriptions of additional services(such as shipping/delivery arrangements) on the Auctiondirectjapan.com Site. Auctiondirectjapan.com uses your registration information according to the Service provisions.
You will be allowed to access the Auctiondirectjapan.com Site when you (a) agree to the Agreement, (b) provide your required personal information specified on the registration screen, and (c) obtain a unique Auctiondirectjapan.com customer ID. You will select your own password.
Members are referred to as individuals, corporations, or individuals representing corporations who agree to use the Service for personal or commercial purposes.
Auctiondirectjapan.com reserves the right to terminate the accounts of members without notice in the following circumstances:
When a member is in breach or violation of the Agreement.
When a member, either an individual or corporation, is bankrupt or when the possibility of bankruptcy is determined by Auctiondirectjapan.com against the member.
When the registration information provided by a member was proven to be untrue, inaccurate,or incomplete.
When a member exhibited default of payment for vehicles ordered on the Auctiondirectjapan.com Site.
When Auctiondirectjapan.com, in its sole discretion, determines that the member is no longer qualified for membership.
Disqualification of membership will not discharge the member from fulfillment of any obligation,the member is obliged to pay the outstanding balance upon payment demand by Auctiondirectjapan.com.
You agree to: (a) provide accurate and current information on the registration form and (b) promptly update the registration data in case of any changes in the data. You acknowledge and agree that Auctiondirectjapan.com will not be responsible for any loss due to disrupted delivery of the Service (such as delivery/shipping arrangements), resulting from your failure to promptly update the data. 4. Maintaining your ID and password
You are responsible for maintaining the confidentiality of your ID and password designated by Auctiondirectjapan.com.
You acknowledge that you will be solely responsible for, and indemnify Auctiondirectjapan.com from, any loss or damage to Auctiondirectjapan.com or third parties arising from your failure to sufficiently maintain or improperly use your ID and password. Consequently, Auctiondirectjapan.com will not be liable for any loss or damage to you arising from the foregoing reason.
You agree to notify AutoSalesJapan.com if you have proof of, or reasonable grounds to suspect, any unauthorized use of such information.
By clicking on either "Confirm" button on Offer/Confirm Offer screen or "Place a Bid" button on the Auction screen of your desired vehicle, you are considered to have confirmed your intention to purchase the vehicle.
A sales contract for a vehicle is complete when you receive a "Sales
Contract email" upon receipt of your offer by Auctiondirectjapan.com
or conclusion of an online auction.
In conjunction with the "Sales Contract email," description of the purchased vehicle will be added to the Purchase History and an invoice will be available for you to print on your Members page. We can also mail invoices to our domestic customers.
The ownership of a vehicle is transferred to you when your payment is confirmed in our bank account. After the transfer of the ownership, you exposure to risk of any loss or damage for the vehicle. If you request the delivery/shipping services to Auctiondirectjapan.com, Auctiondirectjapan.com accept liability for the damage of the vehicle in our Claim Terms.
Sales agreements placed through means other than the foregoing, including verbal agreements, fax and email correspondence (except the foregoing email notification), regardless of your interpretation of such agreements, are not accepted as the official sales agreements with Auctiondirectjapan.com and thus will indemnify Auctiondirectjapan.com from any damage arising from such engagements.
You agree to remit your full payment by wire transfer to the bank account specified on your invoice within 48 hours of completion of a sales contract, and fax us the receipt of the remittance for confirmation (Credit Card payment is accepted for purchases of spare parts only). Please make sure to write down your customer ID and the Stock Number of the vehicle when doing so.
Delay of your payment without notice may lead to a cancellation of your sales contract, in which case we will notify you by email.
All prices on the Auctiondirectjapan.com Site reflect vehicle prices only. Additional charges will apply when you request the delivery/shipping arrangements by Auctiondirectjapan.com. As a general rule, the delivery method is to be determined at the time of purchase and the shipping charge is due along with the vehicle cost. Delivery/Shipping charges on the Auctiondirectjapan.com Site are for your reference only. The exact charges will be available on your invoices.
A prompt delivery/shipping arrangement by Auctiondirectjapan.com is available upon request after your payment is confirmed. Once the delivery/shipping schedule is determined, we will add the information on your Members page and notify you by email.
We accept liability for the damage of the car sold only from our own stock caused by Auctiondirectjapan.com or its contracted vendors during delivery/storage to the extent provided in our Claim Terms. We will not be responsible for any damages caused after the shipment of cargo has been executed from the Japanese port; therefore, it is recommended that you cover your vehicle with appropriate insurance at the time of your purchase.
Import Licensing and All Other Legislative Obligations to Export: Must be carried by the Importer.
All document for the vehicle will be posted to you following up with delivery of the vehicle. If Auctiondirectjapan.com make shipping arrangement at your request, all document including Bill of Lading will be sent by DHL or EMS after the ships departure.
The following prerequisites must be met before
placing your bid on our online auction site:
All information you wrote of your registration form must be correct such as email address, phone number, fax number, and your address.
Deposit must be paid before placing your bid.
In the event that Auctiondirectjapan.com, in its sole discretion, determines that you are disqualified for bidding, your bidding qualification may be terminated regardless of your fulfillment of the conditions set above.
The prices on the Auction List reflect vehicle prices only. Additional delivery/shipping charges will apply when you request a delivery/shipping arrangement. Please select a destination and shipping method when placing a bid.
There are two methods of purchasing: From our own stock and from Auction Agent Service (Japanese auction houses) Please see "HOW It Works" for more details.
Upon conclusion of an auction, the winner will receive a Sales Contract email. Within 48 hours of the completion of a sales contract, please remit your payment by telegraphic transfer to the bank account specified on your invoice. Please note that a cancellation of the sales contract will not be permitted after winning the bid.
You can check "AUCTION USER AGREEMENT" when you use Japanese Auction Service.
BASIC WARRANTY Auto Trading Rock Co., Ltd. will only accept reasonable claims against its vehicles within 7 days after the arrival date of the vehicle at the customer's port. You, customers, must understand that the 1 week period for claims begins as soon as the vehicle has arrived at the customer's destination port. You, customers, are highly encouraged to make all necessary payments at the earliest possible time to avoid delay acquiring their vehicles. This strict policy is necessary because customers who delay their payments let the vehicle be under additional waiting (which means additional risk to the vehicle) inside the in-bond storage facilities within the port.
Reasonable claims made within 1 week after the arrival date will be honored by negotiation. You, customers, must supply proof (depending on the seriousness of the claim; for example pictures, inspection reports etc.) to Auto Trading Rock Co., Ltd. Claims must meet two conditions. First, the proof must clearly show that the received condition is different from the condition detailed on AuctionDirectJapan's website. Auto Trading Rock Co., Ltd maintains detailed records of each vehicle it handles; these records will be compared with the claims. Second, the damages must not have obviously occurred in transit overseas or within customs/port storage facilities.
Responsibility to avoid claims When information of vehicle is posted on the Auctiondirectjapan.com site, Auctiondirectjapan.com shall attempt to provide the most accurate information possible, and shall base sales on the said information. For an error in the information, Auctiondirectjapan.com shall bear liability to indemnify damages to the extent required by the Agreement. When Auctiondirectjapan.com contracts a delivery and shipment, Auctiondirectjapan.com shall attempt to prevent damage to the vehicle caused by accident, etc. In the event that damage is incurred, Auctiondirectjapan.com shall indemnify the damage in accordance with the Agreement. Auctiondirectjapan.com shall address claims from members with good faith, and shall attempt to satisfactorily solve the issue through mutual agreement.
Conditions for claims Auctiondirectjapan.com will accept a claims from you when the following conditions are met:(Purchasing cars from Japanese Auction Service is different from here. Please see Auction User Agreement for the Japanese Auction Service).
The claim is made within 7 days from the date of arrival at the designated place of delivery of the vehicle, or designated port.
The price of the principle vehicle is not less than JPY100,000 in the case of damaged or used cars, and not less than JPY500,000 in the case of boats. (Auctiondirectjapan.com may receive the claim regardless of the price, if the basis of the claim is clearly an error in description, or the responsibility of Auctiondirectjapan.com is considered to be extremely weighty.)
With regard to the contents of the declared claim, you shall be responsible to make clear the location where the loss in question has occurred, and prepare photographic or documented evidence as specified below.
You may submit the vehicle description from the Auctiondirectjapan.com site, or submit the contents and history (email etc.) received from an Auctiondirectjapan.com sales representative prior to purchase.
Steps to file a claim You shall file the claim, upon verifying that the above conditions have been fulfilled.
Upon discovery of the problem, the member shall immediately inform an Auctiondirectjapan.com sales representative of the said problem.
The Auctiondirectjapan.com sales representative will send you a claim filing form via e-mail.
The member shall send the claim form with the customer user column filled out with a description and the amount of damages or other issues in detail, along with photographic and documented evidence to the Auctiondirectjapan.com sales representative.
After having careful examination and inspection of the contents of the claim, Auctiondirectjapan.com shall contact and consult you regarding the amount of indemnification and the method of indemnification.

Method of indemnification payment Auctiondirectjapan.com shall indemnify the contents of the loss as agreed upon with the member by any of the following methods:
Auctiondirectjapan.com shall keep the amount of indemnification as a receipt in advance of your next purchase.
Auctiondirectjapan.com shall arrange and send parts to replace the lost or damaged parts.
Auctiondirectjapan.com shall reimburse the bank account designated by you.
You agree not to use any of the content provided through the Auctiondirectjapan.com Site in a way that constitutes infringement of patents, utility model rights, copyrights, trademarks, design rights, rights of likeness, and privacy rights.
In the event that you violate the above provision, Auctiondirectjapan.com may demand that you make reparation for the damage arising from such infringements to the reasonable extent that would not offend public order and morals.
You agree that Auctiondirectjapan.com will accept liability for damages resulting from the delayed provision of, modification, interruption, or termination of the Service, or damages arising from any other matters relating to the use of the Service, unless otherwise brought about intentionally or due to gross negligence by Auctiondirectjapan.com, to the extent specified in our Terms of Claim.
This Agreement shall be governed by the applicable laws of Japan. You and Auctiondirectjapan.com agree to submit to exclusive jurisdiction of Fukuoka district court in Japan.
AuctionDirectJapan.com provides the most advanced
online auction service online. Members can access the website and view
the auction list (complete details and photos). After making deposit,
members can set budgets until before the auction starts on cars you intend
to purchase. During the day of the vehicle auction, AuctionDirectJapan.com
will bid for the members on his behalf up until his budget. If the car
is successfully purchased, it will be shown at the members account.
These rules apply to AuctionDirectJapan.com Japanese
Online Auction System: Members can freely browse auction lists and those
who want to bid/set budgets on auction cars must send a deposit first
(please see DEPOSIT INFORMATION below).

AuctionDirectJapan.com holds the right to bid 10K YEN above a customers set budget price. Although very rare, the customer must agree to purchase the vehicle even if the final bid price is 10K YEN(10,000) above his set budget because the bidding system in Japanese Auctions is extremely fast.
If more than one member places a budget on the same car,
the member with the higher budget will get the car (if AuctionDirectJapan.com
wins the bid). If more than one member places the SAME budget
on the same car, the member who set the budget first will
acquire the car (if AuctionDirectJapan.com wins the bid).
The customer can make unlimited bids until the customer wins
the bid, but on each failed bid, 1,000 Yen is charged
by Auction House (We will deduct from your balance) and only
1 purchase will be allowed. Therefore, AuctionDIrectJapan
recommend that you should check the "Recent Market Price"
before you decide set a budget.
Members can change or cancel submitted budget BEFORE the auction starts. After the auction starts, the member cannot change or cancel his budget. If the member cancels his budget, the member will lose his deposit.
Exact auction starting times and ending times are NOT POSTED. This is because the starting & ending times of Japanese auctions vary from day to day.AUctionDirectJapan.com can only state auction time roughly begin in the morning and end in the evening (JAPAN TIME). Members must be aware of these general times when placing/canceling budgets. AuctionDirectJapan.com regrets any inconveniences caused by this. Therefore, AuctionDirectJapan.com recommends that if a member is unsure about the auction times and wishes to cancel/change his budget, the member should contact AuctionDirectJapan by telephone.
Please make sure you inform us of the correct VEHICLE/LOT NUMBER and BID PRICE. AuctionDirectJapan.com bears no responsibility for incorrect information supplied by you.
If AuctionDirectJapan is able to bid & purchase a vehicle at or below
the customers set budget, the customer will be contacted by phone or
email. And AuctionDirectJapan will automatically transfer the winning
information into the customers account. If the customer cancels at this
point, he will lose his deposit.
The customer must provide deal term and consignee information to AuctionDirectJapan within three days, which is required for a Performa Invoice that will be sent out once the information is received.
The remaining portion of the transaction will proceed in the same way as normal purchases from our stock of AuctionDirectJapan (please see Terms and Conditions).
Customers must send a 100,000 YEN deposit to set budgets for AuctionDirectJapan's service of Japanese Auctions and One Price. This deposit is only valid for 1 purchase in the auction. If a customer wishes to purchase 2 cars, you must send 2 deposits. If a customer places budgets on 5 different cars but only sends 1 deposit; as soon as 1 purchase is made, the remaining budgets will be ignored (for example, if AuctionDirectJapan successfully bids & purchases the first car (out of the 5), the remaining 4 budgets will be ignored).
The deposit is completely refundable at anytime. However, the customer must pay ALL BANK CHARGES (transaction fees). If the deposit was made by credit card, the deposit will only be refundable 1 month after the payment date. Additionally AuctionDirectJapan must charge a 3% refund processing fee plus bank changes (transaction fees).
AuctionDirectJapan will not ship your vehicle until the rest of the total invoice amount is received since, as you know, we are doing this service at extremely lower charge so that all the payment to Japanese Auction Hole must be paid by customers. Because of this, AuctionDirectJapan recommends customers to send more than 100,000 YEN as their deposit (100,000 YEN is the minimum deposit amount) so that AuctionDirectJapan can ship their vehicle immediately (this will also save your bank fees from sending money several times).
AuctionDirectJapan reserves the right to refuse or cancel registration to
our Japanese Auction Service. In this case, AuctionDirectJapan will
refund the customers deposit subject to charges described above. Customers
accessing our Japanese Auction and One Price Service without successful
purchases within a reasonable time frame are subject to auction access
cancellation and deposit refund.
Your payment has to be made within 48 hours by Telegraphic Transfer after the issue of your invoice. And send us a copy of the Statement of the Remittance immediately by fax for confirmation.
Delay of your payment will lead to cancellation of your sales contract, wihich means your deposit will not be refounded, in which case we will notify you by email.
Customers can cancel or change their
budgets freely BEFORE the auction (which the customer has submitted
bids to) starts. Budgets cannot be changed or cancelled AFTER the auction
starts. If a customer cancels a budget anytime after the auction
has started, AuctionDirectJapan reserves the right to confiscate that
customers deposit as a penalty and/or cancel that customer's
account. This usually applies if AuctionDirectJapan has successfully
purchased a vehicle at the budget a customer stated and the customer
requests to cancel.

Japanese Auctions will follow the posted schedule
on the top page of the Japanese Online Auction System. NO EXACT AUCTION
STARTING/ENDING TIMES ARE POSTED. Auctions open for bidding between
6PM and 8PM (Japan time) the night before the auction. Auctions close
for bidding between 7AM and 9AM (Japan time) the morning of the auction.
At this time, the actual auction will start, and no more bids/cancellations/changes
will be accepted.
Customers must realize that you, customers,
are purchasing the vehicle 'AS IS' in its auction condition.
Auto Trading Rock Co., Ltd. provides no warranty and cannot accept
any claims on cars transported directly to the port. The customer
must assume all risks. The car may be dirty, empty on oil
etc. Because of this, AuctionDirectJapan recommends that after
receiving the car(s), customers should bring the car(s) to
nearest service station to check oils and check up before
driving long distance. We will have an optional service for
check up (Please contact to a staff of AuctionDirectJapan).
Auto Trading Rock Co., Ltd. cannot be held responsible
for not successfully submitting/changing/canceling a budget
due to computer error, and delay in the customer's internet
connection. AuctionDirectJapan bears no responsibility for
incorrect information supplied by you. These policies must
be strictly enforced in order to maintain a fair auction for
all our customers.
